We’ve decided to get a couple of off-label use-related items off of our to-do-eventually list today. The first we’ve alluded to already. It’s the First Amendment litigation that Allergan recently commenced against the FDA involving the truthful “promotion” of off-label use (specifically use of Botox to treat muscle spasticity). Johnson and Johnson states they are not entering the bio-similar market, yet

and Teva have announced and even made some early investments.  Bio-Similars appear to have the makings of the next “generic” type of drug, not completely generic, but a drug with the same outcome at a cheaper price.  In other news today the company announced the elimination of 900 positions, mostly sales.
