The Creeping Demise (We Hope) of Market Share Liability

Last week we put up a postcommenting on something that we thought was wrong with New Jersey law. This week we’re compelled to comment on something that the New Jersey courts have gotten right – they don’t like market share liability – maybe not quite as thoroughly as we detest it, but enough that there hasn’t been a successful case in almost forever.

No State-Law Market For “Fraud On The Market”

As we said last week, because it’s a Dechert case, we can’t comment directly on Clark v. Pfizer, Inc., 2010 WL 163583, slip op.(Pa. Super. Jan. 19, 2010). However, we were sufficiently inspired by what’s in the opinion that we thought this would be a good time to put in our two cents worth about one of the theories that theClark plaintiffs pursued: “fraud on the market.”

Cost Of Litigation Drives Accutane Off The Market

Bloomberg News reported this moments ago:

“Roche Holding AG, the world’s biggest maker of cancer drugs, is pulling its Accutane acne medicine from the U.S. market after juries awarded at least $33 million in damages to users who blamed the drug for bowel disease.”

Here’s our take: The cause of inflammatory bowel disease is unknown. There’s essentially no scientific evidence linking Accutane to that condition. (Here’s a (more…)

Genentech Announces Voluntary Withdrawal of Raptiva from the U.S. Market

The heartbreak of psoriasis has one more heartbreak, as with many other drugs in the news of late, potential side effects are the news here.  BD 
South San Francisco, Calif.  –  April 8, 2009 –
Genentech, Inc. announced today a phased voluntary withdrawal of the psoriasis drug
Raptiva® (efalizumab) from the U.S. market. The company’s decision is based on the association of Raptiva with an increased risk of progressive multifocal leukoencephalopathy (more…)

Johnson and Johnson states they are not entering the bio-similar market, yet

and Teva have announced and even made some early investments.  Bio-Similars appear to have the makings of the next “generic” type of drug, not completely generic, but a drug with the same outcome at a cheaper price.  In other news today the company announced the elimination of 900 positions, mostly sales.
